The website [rksoft.com.tr/en] acts as a "data controller" within the scope of Law No. 6698 on the Protection of Personal Data (PDPA) in relation to the personal data of our users. This Information Notice has been prepared to inform our users in accordance with the relevant law and regulations.

Personal data of users is processed within the framework of Articles 5 and 6 of the PDPA for the following purposes:

Transfer of Personal Data

Personal data of users may be shared with company officials, business partners, legally authorized public institutions, and private entities within the framework of the data processing conditions and purposes specified in Articles 8 and 9 of the PDPA. Personal data may be transferred for the following reasons:

User Consent Regarding Personal Data Processing

According to Article 5, Paragraph 2 of the PDPA, personal data may be processed without the explicit consent of users under the following conditions:

  • If it is explicitly provided for by law.
  • If it is necessary to protect the life or physical integrity of the data subject or another person who is unable to give consent due to actual impossibility or whose consent is not legally valid.
  • If processing is directly related to the establishment or execution of a contract.
  • If it is necessary for the data controller to fulfill its legal obligations.
  • If the data has been made public by the data subject.
  • If processing is necessary for the establishment, exercise, or protection of a legal right.
  • If processing is required for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

Users do not need to provide explicit consent for processing personal data in these cases. The service provided under the [rksoft.com.tr/en] membership agreement falls within the scope of Article 5, Paragraph 2 (c) of the PDPA.

 

Method and Legal Grounds for Collecting Personal Data

Personal data is collected electronically from users. The personal data collected for the legal reasons stated above may be processed and transferred within the framework of Articles 5 and 6 of the PDPA and the purposes specified in this Information Notice.

 

Rights of Users as Data Subjects

According to Article 11 of the PDPA, data subjects have the right to:

  1. Learn whether their personal data is being processed.
  2. Request information regarding the processing of their personal data.
  3. Learn the purpose of processing and whether their personal data is used in accordance with that purpose.
  4. Learn about third parties to whom their personal data is transferred, domestically or internationally.
  5. Request the correction of incomplete or incorrect personal data and request notification of such corrections to third parties to whom the data was transferred.
  6. Request the deletion or destruction of their personal data, even if it has been processed in accordance with the PDPA and other relevant laws, if the reasons requiring processing no longer exist, and request notification of such actions to third parties to whom the data was transferred.
  7. Object to the processing of their personal data exclusively by automated systems, if such processing results in an unfavorable outcome for them.
  8. Demand compensation for damages incurred due to the unlawful processing of their personal data.
